Marblejar Fee Agreement

The following is our fee agreement based on a contingency search. If these terms do not reflect your understanding of our agreement, please call us immediately.

Service Fee(s)
Our Self-Service Search & Match fee for Permanent Positions is equal to ten (10)% of the candidate's first year income guarantee. Self Service Search & Match fees apply when the candidate’s information has been posted on our site at the time the client initiates their search for an IT professional. (For candidates whose principal place of employment is taxable as required by law, the amount of the tax will be added to your invoice).

Our Dedicated Recruiter Service fee for Permanent Positions is equal to twenty (20)% of the candidate's first year income guarantee. Dedicated Recruiter Service fees apply when the candidate’s resume and profile do not currently reside on our site at the time the client initiates their search for an IT professional, and a Marblejar recruiter is asked to conduct a full search of our network and present candidates to the client via our web site. (For candidates whose principal place of employment is taxable as required by law, the amount of the tax will be added to your invoice).

For Contract Assignments, you are required to pay a service fee equal to twenty (20)% of the hourly bill rate of such Resource on a monthly basis based upon the total number of hours the IT professional works. A signed time sheet verifying those hours must be submitted weekly to the Marblejar office. A monthly invoice will be issued based on the hours recorded on the timesheets provided.

For Contract to permanent positions, you are required to pay a service fee equal to twenty (20)% of the hourly rate of such Resource on a monthly basis based upon the total number of hours the IT professional works. In addition to the contract assignment fee, the following referral scale will be in effect:

Guarantee
If the service relationship between you and the candidate is terminated for any reason before the 60th calendar day after its start, we will replace the candidate, according to our replacement credit rates, provided that you notify us in writing of all facts relating to the termination of the relationship within five (5) business days after its termination. This guarantee is not applicable if the service relationship is terminated because the position is eliminated or because you have insufficient work for the candidate. This guarantee is to allow you to satisfy yourself that the candidate has the requisite experience and qualifications, and that information provided by this candidate and other sources, directly or through us, is accurate. THIS GUARANTEE SHALL BE YOUR SOLE REMEDY.



Replacement Credit Rates Schedule

Separation 0 to 30 calendar days, 100% of initial fee credit. Separation 31 to 60 days, 1/60 of the initial fee credit for each calendar day during that period on which you did not employ the candidate.

Terms
Our service fee will be invoiced when you and the candidate agree to enter into the service relationship. Our terms are: Net due on the date the candidate begins the service relationship with you. Our guarantee is valid only if we receive payment of our service fee, in full; within 30 days from the date the service relationship starts. Past due payments are subject to 1 ˝ % interest charge per month, 18% per annum. Your acceptance of referrals from us shall be conclusive evidence of your acceptance of our schedule of charges, terms and conditions, unless we have signed a written modification. If collection activities are necessary, you agree to pay all expenses thereof, including reasonable attorney's fees. Your consent to the jurisdiction of the courts of the State of Pennsylvania and agree that its laws shall govern our relationship. Privacy Policy: Marblejar™ cannot and does not control information that other users make available through the Marblejar™ web site. Even though prohibited by this Agreement and by Marblejar's™ general policies, people may nevertheless provide information that is false, harmful or deceptive. Marblejar™ has a Privacy Policy that covers its use of your information that is incorporated herein by reference and the terms of which you acknowledge that you have read and accept and agree to abide by such terms.

All candidates on the Marblejar site are skill tested on-line. Client acknowledges that the IT skill test is administered over the web and that certain limitations are inherent within this process.

Candidates are referred to you in confidence. Should you refer or identify a candidate to another company, which enters into a service relationship with the Candidate, both companies shall be responsible for the payment of the service fee.

The following definitions are applicable to the Agreement: "Candidate" means a person referred to you by us, directly or indirectly. "Refer," means the disclosure by us of the identity of a candidate by any means, orally or in writing. "Service relationship" means our engagement of the services of the candidate in any capacity, including as an employee, independent contractor, consultant, or other representative. "First year's compensation" means a reasonable estimate of all compensation expected to be earned by the candidate during the first year of the service relationship, including wages, salary, draw, fees, commissions, bonuses, and incentives. The estimate is to be determined as of the time when the service relationship is to begin and shall not be increased or decreased thereafter.

We do not discriminate in the acceptance or referral of candidates on the basis of race, color, Religion, sex, age, national origin, marital status, disability, or other protected characteristic(s).

Marblejar reserves the right to reject any information or postings that they feel is inappropriate, offensive, or unprofessional. This can include but is not limited to any postings that require working with companies that produce, develop or distribute, software or web related programs that involve nudity, pornography or other adult related activities. It is the sole discretion of the Marblejar management to determine if the posting(s) violate this clause.
